In a significant development, a three-member bench of the Supreme Court has dismissed the stay order on constituency PB-45, clearing the way for re-election.¹ The decision comes after Advocate Ajmal Ghaffar, representing Pashtunkhwa National Awami Party’s provincial president and former assembly member Nasrullah Zere, argued that the Election Tribunal’s verdict should be upheld, and the membership of the PB-45 MPA should be terminated.
The Supreme Court’s decision vindicates Nasrullah Zere and other candidates who alleged electoral malpractices by Ali Madad Jatak and election staff. With the stay order lifted, re-elections will now be held at 15 polling stations.
