QUETTA: The Balochistan High Court has restrained the concerned quarters from conducting the election of Chairman Pakistan Cricket Board (PCB) on June 27, 2023 till further orders.
The court also ordered to issue notice to the respondents as well as to the Additional Attorney General admitting the constitutional petition filed by one Gul Muhammad Kakar for regular hearing.
The instant petition was also fixed for hearing on July 17, 2023, in view of the forthcoming Eidul Adha holidays as well as two weeks summer vacations of the court.
The order was passed by the division bench of High Court headed by Mr. Justice Naeem Akhtar Afghan.
Earlier, the counsel for the petitioner had contended that constitution of PCB has been restored by Ministry of IPC vide notification dated 22.12.2022 in exercise of powers under section 3 read with section 4 of the sports development and control ordinance 1962, in pursuance whereof vide notification / SRO dated 22.12.2022, IPC constituted a management committee to manage the affairs of PCB with full executive power with the aim of effecting the restoration of departmental cricket structure and other allied matters, including nomination of Board of Governors (BoGs) of PCB and election of Chairman PCB as stipulated in 2014 constitution of PCB within time frame of 120 days, the Management Committee was comprising of Mr. Najam Aziz Sethi as Chairman and 13 members, including the petitioner as Member at S.No. 8, the manage of the above management committee was further extended for two months, i.e., till 21.06.2022 vide notification dated 23.04.2023 by the IPC; the Management committee convened six meetings on different dates; in the last / 6th meeting held on 20.06.2023, the Management Committee notified the members as BoG of PCB according to 2014 constitution of PCB.
The counsel for the petitioner also contended that instead of issuing notification for the above members of BoGs, IPC issued a contradictory notification on 22.06.203 with the following formation of members of BoG of PCB with Mr. Zaka Ashraf (PCB Patron’s nominee) and eight others.
The counsel contended that while issuing the above formation of the members of BoG of PCB vide notification dated 22.06.2023 in contradiction to the nomination of members of BoG by the Management Committee as notified on 20.06.2023, IPC excluded President Peshawar Region, President Karachi Region, President Lahore Region, President Rawalpindi region, representative of Khan Resarch Lab and illegally and unauthorizedly included National Bank of Pakistna, State Bank of Pakistan, president Larkana Region, President Dera Murad Jamali Region and Presidnet Bahawalpur Regionas members of BoG of PCB; the formation of members of BoG of PCB is of great significance as according to Article 7 of the 2014 constitution of PCB, special meeting of members of BoG has to be convened to elect the Chairman PCB from amongst the members of the BoG by a majority of the total members of the BoG and if the special meeting of the Board for choosing the Chairman is conducted on the scheduled date of 27.06.2023 by the illegal and unauthorized members of the BoG of PCB, the same will be in violation of 2014 constitution of PCB and it will deprive the validly nominated members of the BoG which were notified by the Management Committee on 20.06.2023.
Thus, in view of the above contentions so raised by the learned counsel for the petitioner, the court admitted the petition for regular hearing.
